Agreement to these terms
These terms apply when you use the Kayaazh website and Kayaazh applications and integrations (together, the “Services”). By using the Services, you agree to these terms. If you use them on behalf of a business, you confirm that you may accept these terms for that business.
If your business has a separate written agreement with Kayaazh, that agreement takes priority where it differs from these terms.
Using this website
The website describes our services and the kinds of projects we can scope. Service descriptions are not an offer or a guarantee of particular features, results, or timelines; scope, price, and delivery are agreed separately for each project.
Interface illustrations and sample conversations on the website use fictional data and are not product screenshots or recordings.
Sending an enquiry does not create an obligation for you or for us.
Accounts and access
- Access to Kayaazh applications is provided to organisations and the users they authorise.
- Keep your sign-in details confidential and tell us promptly about any unauthorised use.
- You are responsible for activity under your account and for keeping user access up to date.
Acceptable use
You agree not to:
- use the Services for anything unlawful, fraudulent, or harmful;
- send spam or messages to people who have not agreed to receive them;
- attempt to access accounts, data, or systems you are not authorised to use;
- interfere with, overload, or reverse-engineer the Services; or
- upload malicious code or content that infringes the rights of others.
Your data
You keep ownership of the data you or your organisation put into the Services. You give us permission to process it only as needed to provide and support the Services, as described in our Privacy Policy.
You are responsible for having the right to collect and use that data, including any notice or consent needed from employees or customers, for example before using attendance photos, location checks, or customer messaging.
Third-party services
Some features connect to services such as Google, Meta (Facebook, Instagram, or WhatsApp), or messaging and telephony providers. Your use of those services is also governed by their own terms and policies. We are not responsible for third-party services, and features that rely on them may change or stop working if the provider changes its service. You can disconnect a connected account at any time.
AI and automation features
AI-generated responses, voice conversations, and automated actions can be incomplete or inaccurate. Review important outputs before relying on them, and keep human approval in place for actions that affect customers, employees, payments, or legal obligations.
Intellectual property
The Services, including their software, design, and content, and the Kayaazh name and logos, belong to Kayaazh or its licensors. Ownership of custom software built for a client is set out in that client’s project agreement. You may not use our logos or branding without written permission.
Disclaimers
We work to keep the Services available and accurate, but they are provided “as is” and “as available”. To the extent permitted by law, we do not promise that they will be uninterrupted, error-free, or suitable for every purpose, and we do not guarantee particular business results.
Limitation of liability
To the extent permitted by law, Kayaazh is not liable for indirect, incidental, or consequential losses, such as lost profits, revenue, or data, arising from your use of the Services. Nothing in these terms limits liability that cannot be limited by law.
Suspension and termination
You may stop using the Services at any time. We may suspend or end access if these terms are seriously breached, if required by law, or to protect the Services or other users. Where possible, we will give notice first. Data handling on termination follows our Privacy Policy and any agreement with your organisation.
Governing law
These terms are governed by the laws of India.
Changes to these terms
We may update these terms as our Services change. We will post the updated version on this page with a new “Last updated” date. Continuing to use the Services after an update means you accept the updated terms.
